My question involves labor and employment law for the state of: NY
I am considered managment at my job. I work for a dental laboratory in Long Island NY. I was hired as salary not hourly and one of the perks to this job was that we got a bounus every three months as what the called a STAR program. soon after my 90 day probation period this program was taken away. Now after being with the company for three years they just informed my today that they are switching me from salary to hourly pay because they don't think I complete eight hours per day. To make things worse my co-worker who puts in less hours and hardly ever does his job correct(and still manages to have a job) gets salary and his pay has not been changed at all. Is this legal?? If not what can I do?? Plus my co-worker has a huge RX drug problem and my managers are well aware and do nothing. This guys has gone as far as calling a dr an as***** over the phone (still has a job) and is favored. He comes in to work late, takes 1-2 hour breaks and leaves early when he needs to. I on the other hand come in put in eight hours and can only take a half hour lunch break and don't get paid for that. I have to come in a half hour early to make sure I do my eight hours after taking my lunch break. What can I do I feel like I'm being pick it on and this guy get away with murder.Thanks in advance
