My question involves paternity law for the State of: Iowa
Ok, I know my situation is not ideal, but I'm not here to be told that, I already know! So, here goes. I've been seperated since Dec 2007, my ex and I were married for 6 years(and counting) and have three children together. It's taken us so long to actually get around to filing for divorice because we both have major financial issues. I moved in with my boyfriend in August 2008, he has supported my children and I since they day we moved in (and before, he helped out a lot when I was living on
own). In December I found out I was pregnant with my boyfriends child and due in August. I know that legally the baby will be considered my exs and he will have to disestablish paternity....does this require just signing papers or taking a paternity test? Also my boyfriend will be present at the birth, will the baby be able to take his last name? Can he sign the birth certificate, or will he have to take a paternity test before he has any rights? I'm so confussed!!! Help!!!!
