    Default Retirement Funds Garnishable

    Does anyone know if Public Employees Retirement fund is garnishable? It is a small amount each month, and that is the only income he has.
    The retirement was earned in another state and is being sent to Arizona to the bank.
    Also, this is on an old credit card debt that went to judgement. (16k) We have received a summons to bring titles and total income and everything we own including the house. How much can they take, and is bankruptcy an option, we just got it and the court date is June 15, Help?

    Garnishment laws vary by state. Retirement funds generally cannot be directly garnished, but it may be possible to garnish money distributed from a retirement fund once you put it into your bank account.
