    Exclamation Texas Emancipation

    My question involves emancipation laws for the State of: Texas

    Hello, I am 22 years old and living in Texas. I am attending college but still mostly dependent on my parents. I am currently spending the rest of the summer taking over my debts, tuition, and such -- becoming fully independent. My younger sister is 16 years old. She recently came out as gay to my parents. They are putting her in christian programs in an effort to "change" her. It is messing with her head because she is so sure that she is gay and that it was not a choice. She is beginning to have suicidal thoughts because she cannot take living with my parents anymore. I will not have enough money to support her at least until the Fall and I will need her to start working. Is there anyway that she can get emancipated from my parents without their consent? Can she come and live with me until she graduates from high school and earns enough money to attend college?

    Emancipation is about her TOTALLY supporting HERSELF. Doesn't apply to living with a sibling who is helping to support her.

    If mom and dad give permission, she can live with you. If they don't, she can't. As a very outside shot, you could apply through the probate court to become her legal guardian, but if mom and dad are putting a roof over her head, food in her belly, and they object to a change of guardianship, the court isn't likely to budge. And any mention of her reacting to the issue with her parents over her sexual orientation (or ANY issue for that matter) by having suicidal thoughts will be the absolute end of the matter.

    In Texas, at the age of 16, unless she is ALREADY living away from her parents, she cannot be emancipated. And there is no state where she can legally move out of the house at 16 without her parents consent.

    IF your parents agree, she can move in with you. She CANNOT be emancipated under the circumstances you describe.
