    Default My Name is on the Birth Certificate but the Child is Not Biologically Mine

    My question involves paternity law for the State of: New York

    I was in relationship with someone who lied to me about the paternity of a child conceived during our relationship. My name is on the birth certificate and the child has my last name. After a paternity test I we have established that the child who is now 12 years old is not biologically mine. Under the law am I still financially responsible for the child because I was assummed to be the father for so long and is there anyway to have my name removed to from the birth certificate? What are my rights and what are the rights of the child's mother? Also the child was born in New Jersey but currently resides in New Jersey.

    If the law establishes you as legal father, I don't think your name can be removed. After 12 years, are you sure you want to do this? Are you close to your son?

    Well its kind of complicated. The child's mother told me that she was not sure if I was the father when the child was 4 but I never pursued paternity. If fact we stayed together for several years after that. My ex eventually ending up cheating on me again with the man that she both left me for and is now married to. Though my ex still allows me to see the child every so often she feels that I need to fall back from the situation because she is married now and wants the child to establish a relationship with her husband who she calls daddy and has been raising her for the past 8 years. BTW did I mention that she calls me daddy too....crazy! A year ago I had had enough and decided it was time to find out once and for all was she really mine so I took one of those mail in DNA test and it was confirmed that I am not the father. I just want to protect myself because my ex has threathened to take me to court for child support which she feels that she can do because my name is on the birth certificate. I do love the child but at the same time I still feel that I need to protect my rights.
