    Default Abandonment During Pregnancy in Texas

    Statute: Family Code §§ 161.001; 161.003(a)

    Circumstances That Are Grounds for Termination


    "Voluntarily, and with knowledge of the pregnancy,
    abandoned the mother of the child beginning at a
    time during her pregnancy with the child and
    continuing through the birth, failed to provide
    adequate support or medical care for the mother
    during the period of abandonment before the birth
    of the child, and remained apart from the child
    or failed to support the child since the birth;"

    I found this stautue and I'm hoping it will help me in my situation. My ex abandon me when I was 5 months pregnant and any contact we have had has been initiated by me (in my 7th month) through e mail. In couple of the e mails he talked about how he planned to send money and he asked me what I needed. He said that if i respond he would call me. Of course he didn't call. And hasn't bought anything for the baby. I'm now starting my 9th month. Still no word from him. Why do you say "there is no weight against the father's abandonment when he choose not to be present at the signing of the birth certificate/acknowledgement of paternity, because of the fact that they were not marrried." Are you saying the judge probably won't consider his abandonment? Are you speaking from experience. I'm not trying to criticize. Just kinda in the dark here, looking for advice from people who have been in similar situations.

    You're now starting your ninth month of pregnancy? The key portion of the statute, then, is this: "and remained apart from the child or failed to support the child since the birth" - He can't do that before the child is born.
