    Default Old Incident

    My question involves an arrest warrant from the State of: North Carolina

    My wife was involved in an incident with the neighbor lady across the street which kinda got heated and my wife told her to get off our property and pushed her and the lady went home. Then the lady called the Sheriff and he came and talked to everyone and told my wife if she comes back over to call him. Well that was in Feburary and now the lady is threatening to take out a warrant for assault cause she thinks my wife is responsible for her going through a seperation now. My question is, how long can a person wait before they take out a warrant and also does it matter that the officer came out and talked with everyone and nothing was done that night. The officer even told us that she was drunk.

    If an officer came out to talk to everybody, then the police are already aware of the incident. Although I make no claim of ability to foresee the future, they're probably not going to be inspired to take action months after-the-fact if she comes in and tries to reopen what they consider to be a closed matter.

    For most misdemeanors, NC has a two year statute of limitations.

    And individuals don't take out warrants. Judges issue warrants. All she can do is call law enforcement, which she has already done, and they've closed the matter. Done. Over. She can threaten until the cows come home, but it's not up to her and the party who COULD request a warrant (law enforcement via a report to the prosecutor's office) obviously decided at the time not to pursue the matter.
