    Exclamation Theft by Deception $300 or More

    My question involves criminal law for the state of: Kentucky.

    Okay here is the story:

    I have been a Walmart employee since October of last year. On April 20, I came in from school and went straight to work. I was pulled off my register and locked in a backroom with my Manager and a guy from Asset Protection. He began talking with me, asking about my life, and began to yell and scream at me, calling me a thief, and a liar, and that I was scum. He then told me that if I filled out a confession I would be let go and sent home. They left the room, locking it. I filled out the confession, but I talked about mainly how Walmart mentally abused and stressed me out, and what I truly had done. I had Shoplifted 3 items, I did take $100.00 out of my register, and all the cashiers up front help each other out by Price Overriding cheap merchandise for each other. I had 4 items that were a total of $50.00 price override for $5 a piece, which was a total of $23.00. The locked me back up in the room until around 9 o'clock where a police officer came in and read me my Miranda rights. I then proceeded to tell him I wanted to speak with a lawyer, and if I was going to be arrested tonight. He told me it was up to the store, and my manager told me it was up to him. Well, I was terminated and then arrested at 10. I was locked in that room from 6 to 10 and not allowed to leave, which is apparently False Imprisonment. I also did NONE of this that day, so technically I was falsely arrested. I am still in High School, a 3.4 GPA student, never been in trouble my life, facing a Felony charge which causes me to loose all of my FASFA which is paying for my college. I have been accepted to college, I have won countless awards for my artistic skills and community service. I live in Government housing with my mother and brother. My mother does not work and is currently attending college. My brother is 13 and in 8th grade. I was the only one supporting my family, paying $300 in rent, plus all utilities while trying to finish up my last year in high school. The $100 I took went directly to bills. I didn't take it in a lump sum tho, it was $20 ever two weeks. That was it. Walmat is accusing me of taking tons of money, phone cards, and other crazy stuff. First off, there are more than one cashier on a register at a time, and when I say that, there are usually about 5 cashiers on the register I am on before I get there, so the money could go missing at any time. I also took money out of the register for change, and because of the fact our registers are so old, the change orders do not go through like they are supposed to, so we put our money in our bags if we can't get it back in our register. So, money does go missing easily from the drawers. Also instead of idling the register like we are supposed to, to make their score card look better for the store, they have us hit the credit key which sort of idles our register, but if you press clear it signs you automatically back on with no password, and anyone can get on your register at that point. They also do not check our drawers, and instead of putting a new drawer in like they are supposed to, we each use the same drawer as I mentioned above, they do not check our drawers or have us or them count them down. They simply print out a receipt and shove all the money in a box (which can be taken at any time). I know that almost all the cameras in that store were broken up until a week ago, and that there are tons of employees stealing from that store, and they are trying to pin it all on me. I had my first court date last Thursday, in which my Lawyer waved my 1020 and asked for a continuation. She wanted to speak to Jim Crawford the Commonwealth Attorney. Tapes were taken into evidence according to the police report, I do not know what is on them, I do believe that one of them show me shoplifting. But as I said, if the other shows me taking money out of the register, it could be for simply change. They also have a typed out list of things that I have apparently taken. They believe that I also have started a "smuggling" ring with another employee who was fired for overriding those 4 items for me. He is being charged with Theft by Deception under $300 which is a misdemeanor, and he was fired. He was not locked up also, but they forced him to fill out a confession without his mother, or a lawyer present, and his a Juvenile. Can anyone else see how screwed up this is? And what do you think the outcome will be? I'm scared, I Screwed up, but what Walmart has done to me is wrong on all accounts. Do you think there is anyway of getting this case dropped on lack of evidence, or the fact they locked me in a room for a long period of time, forced me to fill out a confession and what not? My next court date is May 21st, and I have a over night school state competition which I am attending and the Judge approved for me to attend. My mother is going for me.

    1. Yes; can YOU?!!
    2. Years of denial and blaming others. Possibly jail time.
    3. Lack of Evidence?!!! They have a ton of it. Supplied by YOU. They are allowed to detain you for a reasonable period of time. With all that they had on you, four hours sounds reasonable to me. They wanted to get the entire story.
