    Default Police Kicking My Door In

    My question involves police conduct in the State of: Wisconsin


    i recently came home from a weekend at my sisters, and when i walk in the door i see my nephew sitting on my couch, first i ask him.. how did you get in? .. he replies "i got a ticket and the cop kicked the back door in" .. i was extremely aggravated and shocked, so i go to the back door, and sure enough, the back door is cracked in half almost (top to bottom, not side to side), and the side panel where the door goes in is broken off... so much that the door will not even close anymore.

    So a $250 door is broken and nobody but the police to blame..

    my nephew also stated that when nobody picked up the phone or answered the door, the police officer proceeded to ram the door with his shoulder. until it eventually broke open.

    i know this is not legal, but i was wondering, what can i do to further press charges against the police department.. because if i call them, it will be a police officers word.. against a sixteen year old kids word, i guarantee that.

    Uh, you left something out.

    Why did the police break the door? They may have had legal justification. I suggest your nephew is being less then complete in his disclosure to you.

    For police to break in legally, either no response to a warrant knock was given or exigent/emergency circumstances etc., must be present.


    If was an illegal break in, then some questions need to be asked.

    Agree with jk, some elements are most probably left out from the story, but also, then again, the police don't always follow the law.

    "I got a ticket, cop broke the back door in" hmmm something is missing and should throw red flags up. What kind of ticket was issued? Why would the cop have to break in the back door to issue a ticket.

    I think you need to question that kid some more. Because I feel there is a big piece of the story missing.
