    Default 18-Year-Old Caught Shoplifting in NYC

    I am 18 years old and I live in NYC. I was caught shoplifting about $90 worth of merchandise at filenes basement in union square. I was asked to give my name, address, date of birth, home phone number, parents name, and parents phone number. they asked for my social security number but I said that I didn't know it. they made me sign papers that said that if I was caught in the store, I would be arrested for treapassing. then they gave me a civil demand notice that said I would receive something in the mail about being fined. I was not fingerprinted or arrested but my picture was taken and printed out, along with a picture of the items that I tried to steal. They said that since the value of the goods was less than $100 and I am 18, I would not need a parent to come get me and I would not go to jail.

    this was not my first time stealing from filenes basement and they knew it, and told me that they had seen me previously steal from their store. It was not my first time stealing, but it is definitely my last. I am extremely ashamed and cannot stop thinking about it. on top of that, my sister is a cop. I should have known better. I would be so embarassed if she ever found out.

    I am really worried because I plan on being a teacher in the future and in the meantime, I plan on working at clothing stores. I currently work at an after school program, so I have been previously fingerprinted by the department of health and department of education. But never by the police.

    Will this show up on my permanent record? Also, will this show up on a background check when I apply for a job?

    does this count as being convicted of a crime or misdemeanor?

    how much do you think the civil demand will be? I am extremely worried!

    *NOTE* I am not a lawyer.

    I don't know the Civil Demand for your state. I'd say it could be between $200-500.

    You plan on working as a teacher and at clothing stores. Unless you get a Diversion Program with a good plea deal....say bye-bye to the working in any form of retail. Before going into your teaching program, talk to your college advisor about this - even if you plea down, it may show up as a Criminal Record.

    Yes, whichever criminal charge you end up with will be visible to potential employers.

    Aside from the Civil Demand, you are looking at another $300+ for court fines.

    but if the police was not notified on the spot, shouldn't that mean that this is a personal store matter?

    They never said anything about bringing this case to court and the civil demand notice only said that I would be fined. Does this necessarily mean that I will have to go to court and pay even more for court fines?

    from looking at other threats,
    seems like it is person to store matter.
    think you just pay the civil demand and they wont file a charge against you
    unless you get something in the mail saying you are suppose to appear at court.

    oh, i really hope this is just a person to store matter. i really dont want this to continue to ruin my life.

    i'm becoming extremely paranoid while i'm waiting for the fine to come in the mail. i plan on paying it immediately. i feel so regretful about what i've done. i've never been so sorry in my entire life! i just wish i could go back in time and undo what i've done.

    how long do you think it will take for them to send me the information about my fine? i'm living in constant fear, and i want to intercept the mail before anyone else in my family sees it.

    that really depends now........

    close to the same thing happened to me, though police came and they filed charges...
    im pretty ****ed and hopping if i can complete some program that can just dismiss the charge...>.<

    Try and get an acd. It dismiss the charge after 6 months if you stay out of trouble.If it's your 1st time getting arrested you should have a good shot at getting one or maybe a youthful offender status.Find a lawyer in your area and explain the situation you might be able to get a legal aid.A lawyer can increase the chance of getting in to a diversion program or maybe find some way to get the charges dismissed.

    What's an acd? I didn't get arrested, and I don't know if they're pressing any charges. this is a living NIGHTMARE! Every day, I wake up wishing it's all just a bad dream.
