My question involves labor and employment law for the state of: Michigan
I was employed for three and a half years at a local mom n pop party store. I had recently had to go off work for a week and a half for surgery. When I had notified my boss of this leave and the date of my surgery he was not happy with me at all. I returned a week early and was taking narcotics for pain I was still having from surgery. My register had froze up on me during a transaction and I had done a return of $150.00 on it as the error was $150.00 bottle return and it was suppose to have been a $1.50 bottle return. The register froze up as soon as I hit the bottle return button. I was not sure if the transaction would have been still taken or acted as if it did not happen. So I did the $150.00 bottle return just incase it did in fact take the error one. I then thought to myself I will wait and if I come out $150.00 over then I know why. The register did take the transaction and I can explain the overage. Well in fact I came out like -.12. The boss then takes me in the office and asks me to explain this and I did just as it had happened. He said he would think about this and get back to me. This was on a Thursday April 16, 2009 and on April 20, 2009 he called me at home telling me he has to let me go. And if I was to file for unemployment then he would file charges against me. To me that is harassment and bullying so to speak. None of cameras, like 7 of them, have me taking money or anything of that sort. So how could he prove otherwise that I did indeed take it? Its basically his word against mine. I have a son at home with me fulltime and he does not need to go without his mother if I call the boss' bluff and file. What can I do to lawfully get my unemployment yet not find myself in jail/court for embezzlement charges? Is what he is doing by threatening me against any law here in Michigan?
