    Question Citizenship for My Boyfriend

    My boyfriend was married to a u.s citizen and has a child with that citizen. Is there any way she can still help him get his residency or citizenship?

    Only if they get married again. Or if the two of you get married.

    ACTUALLY married, not "for the green card" married. And only if he's not here illegally.

    Ok. We are going to get ACTUALLY married!! He has been here for almost 9 years so we are not getting married for the green card. We love each other very much! But he is here illegally, so what do we need to do?

    Did he enter legally and just overstay, or did he enter illegally?

    And has he ever been subject to removal proceedings?

    Why didn't he seek permanent residency during his marriage?

    They tried to get his green card while they wree married but got divorced before it was finished. He was approved for a fiance visa though but got the approval notice after he was divorced.

    No he has never been removed from the states or had a removal hearing. He did enter illegally though.

    Don't get married, then, unless you're planning to move back to his homeland with him.

    Since he entered illegally, he is not eligible for adjustment of status, lawful permanent residency, or citizenship.

    He's subject to deportation and a ban of at least ten years, and no guarantee of readmission upon expiration of the ban.

    Had he come in legally and simply overstayed, this could have been handled with two forms and about $1500. Since he came in illegally...there's nothing to be done for him.
