    Default Seeing your own doctor

    My situation is I hurt my back/hip at work, file a claim with my company(which I am a contract worker working inside another company), spoke with WC official, visited their MD and got his evaluation but was dissatisfied with his evaluation/recommendations. Also this MD was a Family Doctor and not a Orthopedic or Orthospine MD, so I was leary of his expertise, so I got a second opinion immediately from an Orthopedic surgeon and his evaluation was was more definitive/conclusive since he did a MRI and Xrays vs. just Xrays as the first Md did and diagnosis were completely different and more serious vs. what the initial MD suggested.(muscle strain/?tear in the hip with MD#1 vs. spinal involvement with disc bulging/pressing on nerve with MD#2). So my question to you, was I in my legal rights to get a second opinion and how do I present this to my WC official/rep.

    Default Second Opinion in California

    According to this article, the answer would seem to depend upon whether or not your employer has created a "Medical Provider Network" (MPN).
    Quote Quoting Second and Third Opinions:
    If the covered employee disputes either the diagnosis or the treatment prescribed by the treating physician, the employee may obtain a second and third opinion from physicians within the MPN. During this process, the employee is required to continue his/her treatment with the treating physician or a physician of his or her choice pursuant to section 9767.6.
    It appears that you are entitled to get a second opinion, but from a doctor selected from a pre-approved pool. Your own doctor can of course continue to treat you, and the comp doctor will probably be willing to review that doctor's assessment and the MRI results. A local workers' compensation lawyer should be able to analyze the comp plan you are under and be more specific about your rights.
