My question involves criminal law for the state of: SC
My younger sister (17) received 2 MIPs at a beach party in SC. She received one for liquor and one for beer. The party was in a house she rented with her friends. One of the girl's Mothers and Grandmother were also there as chaperones. They were all present and cited when the police came. My sister was asleep in bed. There was no alcohol in her room and she hadn't consumed any. She asked the officer (who woke her up) to administer a breathalizer and was denied. Is she still accountable even though there were adults there? It seems like she should be able to get out of this. Apparently if she pleads guilty she can take a class and pay a lesser fine. Eventually her record will be expunged. We can't afford a lawyer, so I'm afraid we have limited options. Any advice would be greatly appreciated. Thanks
