    Unhappy Assaulting a Police Officer

    My question involves criminal law for the state of: Michigan
    My husband was arrested February of this year at 2am for assaulting a police officer. There was two minors in the car who were drunk and one of these minors was driving. The police pulled them over and without even getting their ID's opened the back car door behind the drivers seat, and told my husband to get out of the car. He said "yes, sir" and I guess he was going fast enough for them and they pulled him out of the car and threw him on the ground. The police officer told the other two passengers in the car that they could go and let them leave. The police then proceeded to beat the crap out of my husband while he was on the ground. They finally put him in the back of a police car, all the while my husband keeps asking them why they beat him up and one of the officers started to unroll the window and told him to shut up or they will pepper spray him. While in custody the didn't give him a blanket and as he asked what his charges were they wouldn't tell him. They tasered him twice while on the ground and he has burn marks from the tasers. He also has a scar under his left eye where they dragged him on the ground. He has two witnesses(the two that were there in the car) that will be going to the trial with him but he's worried about going to jail for something he didn't even do. On the date of his pre-trial, his lawyer(who sucks by the way) told him that he bit one officer and pushed the other..and that it wasn't looking good for him. His lawyer post-poned the pre-trial date for tomorrow for discovery purposes, my husband has called him repeatedly to see the discovery packet but his lawyer keeps telling him he hasn't had time to get it. He's looking at 6 months in jail right now and honestly, I don't know what to do. Does anyone have any advice for us? I know that none of you may be lawyers but his lawyer obviously isn't helping us very much right now.

    Well if this story is 100% true (Which I see holes in it), then I am not sure why they would take them out of the car and "throw" them on the ground. Was it a felony stop or something? I can see them getting people out of the car if the driver was drunk and what not, but not throwing them down and tasering them. There is obviously more to this story. Pre-trail date I am sure the DA will offer a plea deal, and remember, these are usually less time in jail than if he looses at trial. As far as the blanket and not telling him the charges in jail. That does not surprise me a bit. If he was in a holding cell, most time they will never give you a blanket. Jail is not mean to be a fun place and that do all they can do make sure you realize this! If he is still in jail, he can write a request to the jail asking for a list of charges. Sorry I cant be much help, but I still dont think we have the entire story. What did he do to get thrown on the ground? Resisted? Why did he get tasered? If he was drunk, he may not even remember everything he did.

    I agree 100% that you would think that there are holes in this story. I wasn't there so I don't know what all happened. I'm upset because they let these minors who were drunk and my husband was buzzed but he wasn't completely wasted just drive off. My husband wouldn't bite any1 I've known this man or 6 years....I talked to both of the witnesses while he was in jail and they both told me the same story...that he didn't do anything for them to throw him on the ground and start beating the crap out of him. The only thing he did was open the car door before they pulled them over because he dropped his wedding ring on the ground. They didn't breathalize any of the people in the car or ask for their id's....but they tell my husband to get out of the car? That just dosen't seem right to me.

    There is much more to this story than you are telling perhaps you do not know the story. Police do not just randomly pull people over and beat them up.

    The reality is he has charges against him. You cant wonder and worry about the minors. Focus on him. Once again, if everyone was drunk, no one is going to have the story right. People cant even do their ABC's correct most the time when you are drunk, let alone remember all the details of something that happens so fast. Tell the judge you feel that your counsel is being ineffective. If he has a public defender, that could explain it. They dont have time to spend days on a case. If there is evidence that he bit the officer, which would be on the camera, and everything else happened, I would not go to trial in a million years. Most agencies have cameras for this purpose. To show the use of force was appropriate so they dont get in trouble. Your husband is not going to tell you the real true story more than likely. By saying you have known him for 6 years is irrelevant. I have know people for 15 years and saw some of the things that happened with them. When you are drunk, you are not thinking, and plus, remember that everyone who has a charge pending is always innocent in their mind no matter if they did it or not.
