    Default Assault and Battery on a Police Officer

    My question involves criminal law for the state of: Louisiana. My wife was charged with battery on a police officer which never happened as she never hit him though he says she did(witnesses will be in court to say that she never touched him as well).I am trying to see what the possible verdict will be and what will the penalty be? hoping for no jail time but not sure what will happen. Any ideas?

    You don't have to hit someone to assault them throwing a punch is assault. If the punch connects that's battery. So I wonder if you are using the terms correctly or if the cop is telling the truth. This can get you long prison sentences she needs a lawyer

    She never even swung at the officer. Witnesses will be in court on the court date that saw the incident and that she never threw a punch or even did anything like that. She also has a clean record by the way.
