My question involves collection proceedings in the State of: Illinois
The sheriff came to my house with a summons two days ago. I have a debt with Capitol One.
I was layed off in 2004 and since then I've been living with my 87 year old mother and taking care for her. I have no income, property or assets.
My concern is that my mother and I have a joint checking account so that I can pay the household bills (with her money) and my mother has bank accounts in which my name appears with her has the trustee.
If a judgement is ruled against me, can my mothers accounts be frozen or used to satisfy the judgement since my name appears on the accounts? Also, since I have no income at this time and the court sets up a payment plan, what will happen if I can't pay?
The summons says:
"YOU ARE SUMMONED and required:
1. To file your written appearence by yourself or your attorney and pay the required fee in room 602, Richard J. Daley Center, Chicago, Illinois, at or before 9:30 AM on 05-12-09.
a. If you are sued for $10,000 or less (which I am) , you need not file an answer unless ordered to do so by the court."
