    Default Caught Shoplifter in Need of Advice

    I was recently caught shoplifting from a military exchange. I was shoplifting for a couple months and returning the items without a receipt in order to get store credit. I was doing this to use the credit to purchase food, gas, toiletries, and necessities, because we are very tight on money. Anyway, as I should have assumed, my stupid plan failed and I was caught. I was very cooperative and forthcoming to the loss prevention personnel and I sincerely regret my actions. I asked them what the procedures were and they simply handed me a civil recovery notice and said they are still investigating and will turn everything over to the military legal office and they will handle it from there.

    I am so scared, I have no idea was is going to happen. Will this stay on my permanent record? Will I have to go to court? Also, is the loss prevention personnel allowed to charge me for an incident that happened months ago? I was under the impression that if you are not caught during that incident, you cannot be charged for it.

    Nevertheless, I am so worried, and I want to know what the procedures are and what is going to happen to me. I plan to pay the civil recovery fee and be as cooperative as possible. I deeply regret my actions and want to pay and move on with my life. Please help!

    You committed a crime. It will be on your record until it is either expunged or removed.

    You WERE caught during the incident. Even if you were not, your impression was incorrect.

    Are you going to be tried by military court?

    thank you for your response. i am very aware of the CRIME i committed. how do i go about getting it expunged or removed? i dont know if i'm going to be tried by military court. i am not in the military, my husband is and i am just a dependent, so i'm not sure if the same rules apply. i have no idea what the process is and was hoping someone could explain what exactly is going to happen. the constant worry of not knowing what is going to happen is killing me. do you have any info?

    You will be tried in a civilian court.

    You will receive a civil demand for a couple of hundred dollars. Pay it.

    If and/or when you are criminally charged (and DeCA has a year to do so), ask your attorney to try and get this charge diverted or some other sentencing method that will allow it to expunge upon completion of all of the terms of your probation.

    Yes, you should consider an attorney. I strongly recommend one.

    Lastly, DeCA is pretty stringent on whom they allow into one of their stores. Odds are that you and your husband will be banned.

    Again, thank you for your quick response.
    I dont have an attorney, I was thinking about it, but planning to wait and see how far it goes. It has been 2 weeks since the incident and I havent heard anything from anyone. I pretty much know for a fact that something will happen, I know it wont be dropped. I was told I would be banned from the store, for anywhere from 6 months to a year, depending on what base legal decides. But I am wondering, does this stay with military legal office and military police, or will I be sent to a civilian magistrate?
    Also, this occurred at an AAFES store, not Deca, I dont know how different their procedures are or if you have any more information on their policies.
