    Default Shoplifting Charges from Department Store

    Please give me some info.. Over a year ago I got caught shoplifting in a department store. It was a value of less than $1000. I went to jail over night, and got out on a PR bond. First of all, what IS a PR Bond and what does that mean?

    So the judge let me do PTI. I started on the program, but then was unable to finish because of stupid reasons, so I was terminated from PTI. I received the letter saying I have been terminated and that they will contact me to let me know when my court date is and to continue on with the normal criminal prosecution.

    I am very scared because I do not know what to expect. Will I have to go to jail? How much will the fine be....approximately? I am really scared about jail....is there even a chance that I will go to jail? And if the fine is huge, will they let me make payments.

    Also...is there any chance that since it happened over a year ago...that the judge will let it slide a little more? And does a witness...or someone from the department store have to be there during the trial? If so..what if they dont show up.

    Please just let me know what to expect.

    A PR bond is a "personal recognizance" bond, meaning that the person is released on recognizance with no bail required.

    You should consult with a local lawyer about the possiblity of getting back into the diversion program, and if that's not possible how best to proceed.

    It's not really the judge's choice. The prosecutor decides whether or not to prosecute, and what the charge will be. The probation department will often make a sentencing recommendation.

    If the case goes to trial, it would almost certainly require a witness from the store to come to testify. If witnesses necessary to prove the prosecution's case fail to appear at trial, a charge is usually dismissed. (Perhaps "without prejudice" meaning that charges can be refiled if witnesses become available.) But with major retailers, you should anticipate that the witnesses will appear.
