    My question involves alienation of affection law for the State of: Mississippi

    I received a summons on a complaint, Alienation of Affection from my boyfriends ex-wife.

    In Dec. 2007 I took on a second job and this is where I met the guy. We didn't actually become friends or even talk to each other until Jan 2008. In her complaint she's accusing me of being in a relationship with him from Dec. 2007 until now. At the time I was filing for a divorce but still living under the same roof as my ex-husband. The guy was going through something very similar, he told me that he and his wife were separated though still living together and he was in the process of getting a divorce. This he told me in January 2008. We exchanged phone numbers mid February 2008. I was looking for apartments and he wanted me to help him look as well. I started communicating via text or calls in early March 2008 (I moved out from my ex-husband in March 2008), I had gotten several applications for him and was giving him information regarding homes for rent as I was doing the same for myself. We didn't begin dating until late May early June, at which time, they were still under the same roof but in different bedrooms. Everyone in his family knows about their living arrangements, i.e., the fact that they had been sleeping in separate rooms for a long time, before we even met. Also, his ex-wife had been cheating on him on and off for a couple of years, and he'd had a couple of girlfriends as well. He filed for a non-contested divorce in July or August 2008 and she countered for a divorce as well. LONG story short, their marriage was over before I came into the picture. What type of proof/evidence should I be collecting for my case. I have an attorney on retainer and they don't seem to be too worried but I want to be prepared and know what I can do to fight this and even head it off. This stupid woman (who's also a cop) is suing me for $150,000.00 and I'm up to my neck in legal fees as is, due to my $10,000.00 divorce. Can I possibly counter-sue her for punitive damages? She's been harassing me on and off since July 2008, following me in her squad car, parking in front of my house, she's tried to run me off the road, followed me on the interstate taking pictures of me, been to my job asking where exactly I worked in the bldg, etc. I have filed two complaints with internal affairs and I'm awaiting the results from a hearing. Her and my ex-husband have been working hand in hand to cause me as much misery as possible. He's mad that I left him after 12 years of sexual, emotional and physical abuse and he only has a few hours a month of supervised visitation and the judge awarded me everything; house, car, his music studio, his cars, etc. My divorce was granted in May 2008 and we just had what I hope to be our last trial a couple of weeks ago. Also, does it help that her divorce was granted on the grounds of cruel and inhumane treatment, something she alleged happened throughout their marriage. She's also told a lot of people that she had been telling him to leave for years. How can she accuse me of being the reason for the demise of their marriage and they were having A LOT of issues, problems, infidelities before I even met him. Any advice or assistance is greatly appreciated.

    A counter-suit to alienation of affections? Unlikely.

    But if you've got evidence to back up your claims of her having marital problems well prior to you entering into the picture, you can certainly use that proof in your defense.

    You really ought to be addressing all of your questions to your lawyer. S/he's got access to all the facts of your divorce and the AA suit.

    I've consulted with my attorney and they don't feel I have anything to worry about. I'm just trying to prepare myself from all angles.
