    Default Picture and Unflattering Comments on MySpace

    My question involves defamation in the state of: Alabama

    The short of it is this: Husband had affair, ended it - other woman not happy!
    Can she copy a picture of me from my Myspace page and paste it on her page and then add comments about me. I know she has her opinion and that is okay, but when it involves a picture that she did not take - is that legal?

    Who took the picture? The person who took the picture owns the copyright.

    That would be the person who would need to file a takedown notice.

    MySpace will accept abuse complaints, and the harassment you describe probably violates their terms of service; however, I have found they act very quickly when you submit a DMCA report about a pilfered picture.
