    Default Child Support in Tennessee

    TN

    My sister left her husband a little over a month ago. They have one child together from the marriage. The husband has not provided any support to the child other than occasionally buying a box of diapers. My sister has been paying all of the bills from the marriage without any help from him as the bills were all in her name. He refuses to help with anything since she left him. (She left him due to his constant infidelity and mental abuse).

    He has recently told her that he doesn't have to do anything for the child as they are still legally married. Is this true? Can he get away with not paying for anything for the child? What happens when they go to court, will the judge order child support from the date of filing or the date of separation?

    He also recently told her that he would go put himself of child support (I am guessing he means that he will go file so that he pays, since he has not kept the child one night since the separation). Does this have any bearings on the amount or will they just plug in the numbers and determine based on the calculator?

    Heavens. Good for your sister, to get away from that!

    Her soon-to-be-ex has a some really stupid ideas about what his responsibilities are. Whether he likes it or not, he IS still responsible for helping to support that child, and no amount of his saying otherwise changes that.

    Support usually dates from the filing date.

    Does this have any bearings on the amount or will they just plug in the numbers and determine based on the calculator?
    Support will be determined by the Tennessee support formula.

    Yes, a judge WILL order support even though they're married.

    I wouldn't hold my breath waiting on him to file. She needs to go file TODAY.

    He will have no say over the amt. of support he pays. (she should gather as much financial info on him as she can legally get, as many people fudge their income so they will pay less support.)

    Thanks for your help. She is meeting with her lawyer this afternoon. I just wanted to provide her with some peace of mind before then.
