    Default Libel by Former Employer

    My question involves defamation in the state of: Libel by former employer.
    My former employer is running for a County Commissioner Position. He mistakenly believed that I had been posting things about him on a forum. I got a phone call from someone that told me to go to this forum and look. He released that I was fired from him because I couldnt pass a background check, but this is a lie. I didnt pass a credit check. No one worked in that office except for me and him at the time that he fired me, and no one else was there. He also proceeded to tell about my husband, which is no ones business, and no one had knowledge of, except for this man. My husband and I have to go to immigration in a few months, and he has tried to use the fact that my husband is from another country to bring hatred to us on this forum. I have a very unusual last name, and no one in this area knows me or my husband because we have just recently moved here. Now when I put in an application for employment, I dont even get a return call. My employer posted my first and last name on this forum, and even went so far as to say that I am a BI--ch and a wh--re , which is not true. Is there anything that I can do?

    Only if you can prove that you are being denied employment as a direct result of his posts.

    So many people aren't getting call backs these days. You basically have to put in hundreds of apps as opposed to the tens we used to have to to get an interview.

    Make the most of any interview you get. They are gold these days.

    What evidence, and I mean real evidence, do you have that any employer has failed to call you SPECIFICALLY BECAUSE of what was posted on this forum?

    Do you have any evidence that any employer has even seen it?

    Because to take any kind of legal action, that is what you will need.

    Employers these days are receiving literally hundreds of applications for any single opening, and the majority of them are not receiving return calls. Without very specific evidence that an employer has used this forum and that the information posted there was the sole reason you were not called (not to mention needing some sort of evidence that when it was posted, the employer KNEW it was false, as opposed to being mistaken) you won't see the inside of a courtroom.
