    Default Conditional Residence Renewal Problem

    Please help me with this problem..

    I was petitioned 2 years ago by my american step-dad which my mother married, who just recently became an American Citizen (I have my greencard now). Because I needed to go back to our country to study for 2 straight years, I filed a travel document(re-entry permit) and it was granted.

    Now, after 2 years, I came back here in the US to renew my greencard(or is this called 'removing conditional residence?") because it is going to expire by May(I'll be here until May). I just filed an I-751(petition for the removal of conditional residence) and received the I-751 Receipt notice which states I can extend my conditional residence status for one year only.

    The problem is that I need to study again for 2 straight years because I have summer classes that school year and it's expensive to go back-and-forth just to renew my greencard. I'm going to file another re-entry permit(travel document) so that I can stay for 2 straight years outside the US, but my conditional residence is going to be expired in a year..

    can anyone suggest or know what to do..?

    The I-751 requires that you wait until 3 months prior to expiration date of your conditional residency to file for the removal of the conditions. However, the USCIS is taking much longer to actually process the requests. Current time in California is 6 months for example. What this means is that your conditional residency would have expired prior to getting the approval to remove the conditions.

    Re-read the receipt notice again carefully. It should say that the conditional residency is automatically extended for 1 year in order to allow them time to process the application without you going out of status. It is very important that you keep that form safe, as it is really the only proof that you will be in status after May.

    You can keep track of the processing times, check the status of your case and also make an INFOPASS appointment to spead to someone in USCIS if you want more clarification at the below website.
