It's still up to the hearing officer, but generally speaking, if your employer does not contest, you'll be eligible for benefits.
I would get something in writing. If you drop the civil suite and all of a sudden, with no warning, your employer fights your unemployment...you could be stuck.
It's situation specific. I have had employees denied UI benefits when I did not contest, simply because the reason their employment ended was a disqualifying reason.
