    Default If Employer Doesn't Contest UI Appeal Do I Automatically Receive Benefits

    My former employer has offered not to contest UI appeal if I drop a pending Civil Service appeal. If they do not contest the UI appeal will I automatically win and receive benefits or is it still up to the hearing officer?

    It's still up to the hearing officer, but generally speaking, if your employer does not contest, you'll be eligible for benefits.

    I would get something in writing. If you drop the civil suite and all of a sudden, with no warning, your employer fights your unemployment...you could be stuck.

    It's situation specific. I have had employees denied UI benefits when I did not contest, simply because the reason their employment ended was a disqualifying reason.
