    Question Assault With Brass Knuckles

    My question involves criminal law for the state of: MN

    I have a simple situation and am trying to stay calm right now to look for a simple answer.

    I just arrived home after attending a house party in my hometown where I was punched in the face more than one time, with brass knuckles.

    I don't think I should go into too much detail for legal reasons but I was using a drug that is currently illegal in the U.S. and this person who was drunken and passed out at the party woke up and saw that I was consuming this substance.

    For whatever reason he disapproves of said substance usage and blindsides me with brass knuckles in the face, hitting me twice very hard, still bleeding an I still have a semi-open wound after 2-3 hours.

    One of my friends told me not to do anything at the time because I was using said substance and I could get in trouble for that. Not to mention the kid I was using said substance with said "i didn't see anything" when I asked him if he just saw what happened. He is obviously trying to protect the kid with the brass knuckles.

    I dont know what to do... please advise.

    Stop doing drugs would be a start. Doing drugs is illegal, which means that using drugs places you around people who break the law, otherwise known as criminals. Criminals do illegal things. Like batter people with weapons.

    Pressing charges will not un-punch your face. It will, however bring your illegal drug use to the attention of authorities.

    From another point of view....

    You doing an illegal drug does not give someone else the right to assault you with a deadly weapon.

    Call the police.

    I am not saying that it does, but to illustrate what I mean, I once had a person complain to me that he was stabbed in a robbery. How was he robbed? Well, it turns out that he was trying to buy cocaine, and the dealer took his money and did not deliver the cocaine. When confronted, the dealer stabbed the wannabe buyer.

    When he gave his statement, the police arrested the dealer, but also arrested the complainant for the felony of buying the cocaine.

    Both very good points.

    Sorry I'm so late to reply but I decided not to press charges in this case. Instead I will opt for anonymous and seemingly random justice.

    That would be a terrible idea.

    Building upon a criminal act by performing another, larger criminal act is a recipe for jail time.
