    Default Previously Rejected Under Section 212(A)(3)(a), Applying After 2 Years on New I-20

    Hi,

    I applied to USA for MS in 2006 and secured scholarship in top ranked universities. However, I did not get visa under section 212(a)3 A probably because I was working in defense laboratory as a scientist then. My visa was rejected twice on the same grounds (in Aug, 2006 and Jan, 2007).

    Subsequently, I left the job in 2007 and started pursuing masters in India and have again secured scholarship for PhD in top ranked US university.

    What are my chances of getting visa this time given that I have left the job and the university is different. How much would my past interviews affect their (consulate) decision this time. Kindly comment. Thanks a lot.

    (a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:
    (3) Security and related grounds.-
    (A) In general.-Any alien who a consular officer or the Attorney General knows, or has reasonable ground to believe, seeks to enter the United States to engage solely, principally, or incidentally in-
    (i) any activity

    (I) to violate any law of the United States relating to espionage or sabotage or

    (II) to violate or evade any law prohibiting the export from the United States of goods, technology, or sensitive information,

    (ii) any other unlawful activity, or

    (iii) any activity a purpose of which is the opposition to, or the control or overthrow of, the Government of the United States by force, violence, or other unlawful means, is inadmissible.
    We have no way of knowing if the concerns have been, or can be, adequately addressed. I suggest that you work with an immigration lawyer.
