My question involves small claims court in the state of: Virginia
Hey all, so I have a situation. I'm currently suing a former roommate of mine who had been living here for about 9 months. During the first half of his time here, he paid me on time for the utilities, which I'm responsible for. We all agreed(without written contract-lesson learned) that I would divide the utility bill by the number of people currently living in the house. Around November, he stopped paying me, claiming that he would "get me the money" etc etc. After hounding him for months, literally, and him never disputing that he owes me the money or whatever, I decided to take him to small claims for the money involved.
I was hoping for advice on what to bring to court, and what my chances are. He seems to think that he'll get out of it somehow and doesn't seem that worried, despite the fact that he also is being sued by our landlord for rent payments which were basically never received. I was thinking of using that fact, along with the fact that he never disputed money owed, and also bring in my other roommate who was present the last time I was paid. Thoughts? I appreciate any help!
