    Default Criminal Trespass at a Store

    My question involves criminal law for the state of: Washington.

    I was caught shoplifting at a Nordstrom store a year and a half ago. At the time, I was told I could not enter the premises for two years.

    Recently, I was not thinking and entered a Nordstrom Rack store and purchased an item with my credit card. I didn't realize until I left that the Nordstrom Rack store I visited may have been the same entity as Nordstrom.

    Nothing happened at the store.

    Is Nordstrom Rack considered the same store as Nordstrom?
    By reviewing credit card information from the purchase I recently made, could they follow up with me and pursue the criminal trespass action?

    You can relax. The odds are very small that they will even figure out that you were in the store in violation of the ban, let alone that they'll try to prosecute you.

    Entering a store in violation of a retailer's ban does put you at risk of prosecution for trespass, so you're best served by staying out of any affiliated store for the next six months.

    I can't believe I had made a stupid mistake like that. When I was walking out, I was so mad at myself. In the end, it is my fault... I AM the one who chose to commit this crime in the first place.

    Although, I am surprised that when I was at the cash register and paying with my credit card, that something didn't alarm the cashier of my name... do you get what I am saying?

    Your name may be on the shoplifter list, but there are many people with the same name.

    Speaking from a database programming perspective, in order to alert the cashier that you have a trespass order by reading your credit card they would also need enough information that uniquely identifies on your credit card and would match their blacklist record. While their blacklist may have your address, DOB, SSN etc, your credit card only stores a name/number and other non-useful banking /security data like checksums etc. I doubt the store's blacklist has your credit card number. Your bank is unlikely to give up your credit card numbers to the store for blacklisting purposes.

    So no... Speaking purely from a database key perspective, I don't see a way of easily *automating* a blacklist check from a credit card swipe.

    Now, if one of the big brother data gathering companies is able to associate your CC# with your record in some other way (like scanning purchases from other subscribing stores) then they could put it all together...
