My question involves a roommate in the State of: New York.
I moved out of my apartment (shared with 3 other roommates) last January on the 1st. I am on the lease for this apartment, along with all three other roommates. I spoke with my building's management when I was planning to leave, and they said I could be removed from the lease for $100 as long as I found a replacement who cleared the credit check. We found a guy to move into my room and when he came to see the place, told him what management required him to do in order to move in:
1) Pay $50 for a credit check and fill out a form
2) Turn in a security deposit check
3) Sign the lease
The new guy moved in before fulfilling these requirements, but with the understanding they would be taken care of after he moved in. After several emails and phone calls to remind him, he refuses to do anything--saying he doesn't want to get on the lease because he'll have to pay for the holes in the walls of the room that he didn't make. We called management to see if they would repaint a room before a new tenant moved in, and they said they'll only do that when everyone moves out.
He has now been in the apartment for almost 4 months. I recently sent him an email explaining that if he doesn't do these things, he will have to move out at the end of next month (giving him more than 30 days notice). He still won't do these things or move out.
I'm afraid to call management because technically he shouldn't have moved in without clearing the credit check. And now it's been almost 4 months, so I'm nervous management will kick everyone out (and everyone will lose their deposits). I don't want to be liable for this apartment when I no longer live there.
Do I have any power over this guy to get him out? Or do I take my chances with management?
