In this case a plea was taken. At the signing of the plea, the defendant asked if the probation would be transferable to another state, and was told yes. After the signing of the plea, and after his first meeting with his probation officer, he is told by the PO office that it MAY transfer IF it is deemed appropriate. Which, of course, is NOT what he was told.
He was told the 2 criteria in which they will transfer probation are A)you were a resident of that state 12 mons or longer (which he was not), or B)you are married to someone in that state (which he is not). Otherwise it will be considered on a case by case basis. Which leads me to my question, what is the likelihood they will approve his transfer (this is the state of WA if that helps)? Here are the criteria unique to his situation: He is expecting his first child in less than a month in said other state. He has job opportunities lined up in that state that he does NOT where he is at, it is too rural and isolated. He does not have a place in WA to stay and is virtually "couch hopping." He wants to be there for his child to know him and to help raise her, while pursuing an education and working. THis is all lined up and waiting for him in the other state. Considering these factors, can someone tell me if the outlook is good as far as his transfer request being approved?
