    Default Divorced alien and a citizen want to get married

    Hello, my situation is complicated enough to make lawyers confused. Immigration has taken their time, extremly long time 6 years to follow up on a previous marriage of my soon to be wife who will as of tomorrow be completing a divorce from her last marriage to a citizen who was a lieing cheating criminal who is to this day dodging private investigators and restraining orders from various women.

    long story short my fiancee and I would like to get married but at the same time they are taking her thru removal proceedings because her 2 year marriage to the previous dirt bag never closed her status as a citizen. She had been separated from her ex for a few years now and we have been dating and reciently been living together for over a year now and now that the court allowed her to complete her divorce without being able to serve her ex with papers allowing her emancipation from the marriage we can finnally procede. However there is a mountain of paperwork to sift through. I understand there is the i-130 and i-485 forms to be filled at the right times, but I dont understand what is required to get married.

    Can someone answer at least can I actually get leaglly married to her while she is still allowed in the country and begin filling the paperwork to get her a possible green card. It's always so much easier in the movies, there are so many forms and waiting periods in oregon we have thought about going to vagas just to avoid the complications of permits and waiting periods?

    Also am I missing any legal restrictions that may apply to her dissolution from her dirtbag ex?

    Short story about me, I am a born and raised american citizen therefore I have absolutely no understanding of us law.

    We are seeking free assistance from a charity lawer but we still dont know if they will take our case in the system.

    If you need to know we live in Oregon and we have neither been convicted of any felonies.

    There is nothing to stop you from marrying her, once she is legally divorced. You should not assume that it will affect the legal proceedings against her - she should continue to work with her immigration lawyer.
