My question involves a traffic citation from the state of: New York.
After I got a cell phone ticket on the Thruway yesterday, I noticed the officer had incorrectly marked the violation as occurring at 5:17 AM instead of 5:17 PM. On the Supporting Deposition, he marked the violation again as AM but my statement correctly as occurring at PM.
Obviously, I have cell phone records that show I wasn't on the phone at 5 AM, but do I have a chance of fighting the ticket on these grounds? Or does the contradiction in the Supporting Deposition work against me?
Ideally I'd like to get a dismissal so I won't have to trek back up for my court date, but the court clerk seemed to think that was almost impossible - and warned me that the officer would likely be given the opportunity to correct the mistake.
Any advice?
