    Default How do I protect myself from wife adding more debt in KS?

    We separated and she moved to a rental house. While not yet legally separated I am concerned that she may add new debt on her own that I may be responsible for. I know I used to see small notices in the local paper "I Jon Doe on this date are only responsible for my own debt"

    Do I need to put a notice in the paper to protect myself? My wife was a very poor money manager. I make 100% of the house payment, utility payments and both car payments.(even though our income is the same) Her car I now have back but made all the payments. Her last vehicle was repossessed and I was able to obtain a loan on her next car at a preferred rate. Both vehicles are in my name while her previous car was solely in her name.

    What do I need to do to protect myself while struggling with all the debt?

    Why not just file for divorce?

    I will be talking with an attorney very soon. I just thought I might need to do something before the divorce happens.

    If she is incurring debt solely under her own name, and she is capable of supporting herself, you're probably not going to have a problem. You can also agree that certain joint debts be paid off from the marital estate at the end of the divorce process. But if she's running up debts on, for example, a jointly held credit card, you should expect that the creditor will come after you for the debt if she defaults on her payments.
