    Default Vacation Policy Change to Use It or Lose It

    This situation is very similar to one that i am encountering here in MA. My employer sent out an email stating a variety of things regarding dealing with our current economy one of which states:

    "4) We are also asking all of you to take your vacations by the end of the year and we are not allowing any carry over into 2010."

    There has been no word of a policy change (nor has one been made as of today).

    As of right now I have 9 days of vacation, by Dec 31 I'll have something like 12 days. Under our current policy we are allowed to carry over something crazy like 5 weeks. So i am no where close of the current cap.

    Can my employer Legally take away any of the days have I have already accrued?

    My understanding of the MA "Use it or lose it" policy sounds more like it allows employers to cap of the amount of time that someone can carry over, not so much throwing away the time already earned. So with that said they can change the policy to state that 0 days can be carried over, but what about all the time that i have earned prior to the policy change?
