My question involves criminal law for the state of: New Jersey
I am currently enrolled in the pre-trial intervention program in NJ. While in the program I was arrested for a new charge: attempting to obtain CDS by fraud ( a 3rd degree felony). If I plead guilty or am convicted I would be terminated from the PTI program and have to face trial on the original charge. However, the new charge was reduced to a disorderly persons violation (a misdemeanor). If I plead guilty to the disorderly persons violation, is that still grounds to terminate me from the PTI program? Is it automatic or is it up to the judge? I have searched several sites and have been unsuccessful in getting an answer to this question.
