    Question Having Somebody Who Is On Probation Live With You

    My question involves criminal law for the state of: Florida

    My fiancee is due to get out of prison in 6 months, and he recently received paperwork pertaining to his release; I'm overjoyed , but PANICKING! He will have to serve a year of probation, and I have no clue what to expect. Will the probation officer contact me to come look at my apt? Will he tell my neighbors? Will I have to show him a copy of my lease? Do I need to have a land line phone? Will he sneeze and be sent back to prison for it? I hear such horror stories. Can anyone give me a clue as what to expect?

    Maybe. That's going to depend largely on the terms of his probation. For instance, if he's been in the clink on DUI charges, it's a good bet his probation will include a "nowhere near booze" clause, which sometimes triggers a home visit.
    Will he tell my neighbors?
    Not usually.

    Will I have to show him a copy of my lease? Do I need to have a land line phone?
    Maybe and maybe.

    The fact is, these things are all dependent on the terms of probation and are handled on a case by case basis. There is no cookie cutter "What to Expect When You're On Probation" guide, you pretty much have to wing it.

    That said, winging it is easy. If he can't have booze, then no booze. If he can't go to particular establishments, then he stays away from those. Obviously, drugs are right out, because if you fail your urine test, it's often back to the clink you'll go.

    And really? How hard is it to follow instructions given by the court? As long as he just does what the court tells him to do, he'll be fine.

    There are no requirements for your house while on probation (such as landline phone, or even having a phone at all). It is not house arrest it is just probation. No one will b notified of any probation of course unless they would also have been notified if he was released without being on probation. In some places the police will stop by your house one time in order to ensure that he lives there. This may be unrelated to probation and may have been done because the human I saw this done to was required to register his address with the police for a different reason. If they do check, they will not come back to your house again unless they are trying to arrest him. If he does not get caught doing something they want to arrest him for, not accused of something he did not do which they think it is legal to arrest him for, and does not miss appointments, he will not be jailed again. You are also not allowed to leave the state, so if he goes out of state he will need to make sure that his name is not "run" while in that state, even if he does not have any warrants, and that he has adequate transportation back before his next probation appointment. This last sentence of course will not affect you as a "human that he is living with".
