    Default Security Deposit Without a Lease - or Moving In

    My question involves a security deposit in the State of: Michigan.

    My husband and I met and worked on renting a house from a gentleman who was renting his house for the first time. We gave a security deposit, but we were never able to come to terms on the lease, and we never signed a lease, etc. We finally decided that we were not comfortable, and decided to move on and look for another home. The owner of the home is threatening to not give back the security deposit unless he can find someone else to rent his house. I do not believe that he can legally withhold our security deposit, but am not sure the proper way to proceed. Would like to not have to go to small claims court if possible!

    Under Michigan law you are considered a month to month tenant. If you failed to give proper notice (30 days) as outlined in state laws, the landlord can hold you liable for the following full month or until a new tenant is found.
