    Default Ambiguous Lease Terms

    My question involves landlord-tenant law in the State of: California

    The lease agreement I have has two conflicting terms checked. It has both a 12 month lease and a month to month tenancy on the lease terms.

    Can I give my 30 days notice at any time? If I do give my 30 days notice, can they take me to court or damage my credit?

    So you have identified a clerical error in your lease. But you haven't given us key information - was your actual agreement for a one year lease term? Although I can't interpret a lease I can't read, I can say this much: There's a significant chance that a court will hold you to your actual agreement.
