    Default Providing Alcohol to Minors in Pennsylvania

    Three of my friends and I are college students in PA. This past weekend we were having a party at our house and unfortunately the police came. One underage person who was there attempted to run but was apprehended and will be charged with MIP. The policeman had us instruct everyone else to leave and lectured us fairly hard.

    After it seemed that everyone had left, he told us to check and make sure everyone was gone. When we came back out, we found out that 2 more underage persons had come out from the front door. We believe that the police attempted to breathalyze them, however the machine failed and they simply drove them back to their room. We do not know if they will be charged.

    So, my friends and I are now being charged with providing alcohol to minors. It seems to us however, that since the police never entered the house to find evidence of the alcohol we allegedly provided, we should have a strong defense in court. Are we correct in thinking that this charge should be avoidable?

    You think the minor who was charged isn't evidence?

    How do you plan to explain how those minors came to be in possession of alcohol prior to being taken away from your party?

    You'd do well to talk to an attorney.

    We will be contacting an attorney.

    It is also true that the minor in question had been drinking before arriving at our house. Does his being at our house automatically imply that we supplied him alcohol?

    I realize that there are no sure things, but in your opinion do we have a case worth fighting?
