    Post Slander from Landlord

    hi, my question involves slander comming from my landlord. it first started off back in november of 08 when my father (my roomate) slipped and fell in the parking lot of our apartment complex. there was about an inch or 2 of snow on the ground and it was ice underneath. as a result of the slip and fall my father had to be rushed to the ER and we figure out that he would have to have back surgery and have 3 disks fused together with steel rods and plates and screws. ever since that day my landlord has disclosed information about me and my father to another tenate. this tenate claims to be a maintainence man for the landlord but i know for a fact that he is in no way qualified for the position and is not an actual employee of my landlord. my question is what can i do to take care of this issue? we live in michigan and my father is on a fixed income, we can't afford to move we can't even afford rent, and my fathers scripts and to pay the utilities every month. please help me with any information you can.

    What does this have to do with Slander? Simply talking to someone about something isn't a crime. Did he make remarks that weren't true? (drug addict, crackhead, something in those lines) If those remarks were made and caused damage to your character or kept you from being hired at a job then yes its slander.

    And how do you know hes not qualified? Nothing says that a maintenence man has to know how to fix everything, the landlord could possibly hire out for plumbing, electrical, etc... Most apartment complexes hire a tenant as maintence simply because they are onsight most of the time and in return usually give free/reduced price apartments.

    Theres nothing you can do.. no laws were broken from things you have stated in your post. If talking about you or your father bothers you confront the landlord, however if you dont have money to move than I would suggest letting things be unless he really slanders you. Not being able to afford the apartment is a whole seperate issue.

    i'm not stupid i know what slander is. and i wouldn't be posting this if it wasn't slander, i know he's not qualified because i saw him try to replace a deadbolt when i moved in and he couldn't figure out how to adjust it so it fit right. whether he is qualified or not is not my problem, i'm sorry i commented on that in my first post. but my problem is i have two other people that have heard the landlord talking trash about me to people who have no concern knowing it.

    I didn't say you were stupid, I simply explained the way things work to you. If your looking for someone to just say yes its slander you've come to the wrong place. How are we supposed to know what he is saying or if its slander if you dont tell us? First you said he said it to one tenant now your saying a few. A little more detail would help in determining the chances of a case.

    I personally have heard him saying to the other tenate that I am a slob, He has saw me selling drugs out of my apartment, He has saw me checking out little kids. those are 3 things that i personally have heard him say. i had 2 people come up to me the other day and tell me that they heard him talking trash about me to another tenate that lives in the same building as they do. they also heard him say that i was selling drugs out of my apartment that i do nothing to try to keep my apartment clean and nice. and i do keep my apartment clean and nice looking. that is the second time that these 2 people have came to me and informed me that they heard him saying those things about me to other people that live here.

    OP, I suppose I have one question which I haven't noticed - and pardon me if I just didn't understand it - in your post: is this supposed trash-talking these third parties are relating to you true? By that I mean simply you said he's telling them things they "have no concern knowing it".

    If it's true what's he saying then you have essentially no leg to stand because truth is an absolute defense to slander (and libel as well).

    Well personally heard him say and third party statements are different. However if none of these things are true and you don't have a bad character or history with any of these statements than yes you can sue him for slander.

    Heres a pretty good legal definition of slander. I know you said you know what it means but this breaks down the essentials and properties of the crime (tort).

    For someone who barely talks to people, it seems that you're awfully in-the-know.

    To prevail in a slander lawsuit you'll have to show that you were actually damaged by this person's speech.

    Michigan's defamation laws are set forth in a statute, MCL 600.2911. An accusation of criminal activity will support an action for defamation, without further proof of damages; although if no economic harm is suffered it can be difficult to win much of an award based upon a claim of damage to your reputation or emotional state. Defamation cases are often money-losing propositions, so it can be hard to find a lawyer willing to represent you on anything but an hourly fee.
