    Default Criminal Damaging Laws in Ohio

    My question involves criminal law for the state of: Ohio

    Me and two friends were charged with criminal damaging of mailboxes. I was only a passenger in the vehicle. I did not cause any of the damage.

    Ohio Law says:
    (A) No person shall cause, or create a substantial risk of physical harm to any property of another without the other person's consent:

    (1) Knowingly, by any means;

    (2) Recklessly, by means of fire, explosion, flood, poison gas, poison, radioactive material, caustic or corrosive material, or other inherently dangerous agency or substance.

    I was not the "person" who caused the damage, therefore would I be guilty of criminal damaging?

    Did you try to stop it? Did you call the police afterwards and report it? If not than technically yes you committed the crime also.
