    Default Harrassment Order Without Hearing

    My question involves restraining orders in the State of: Minnesota

    Son's ex-wife served him with harrassment.
    He responded and got a hearing date.
    At hearing she asked for continunace and got it.
    At second hearing she said she had more things and the judge said she had to serve him with everything so he knows how to respond. Judge gave her one week to serve. She served him. Papers did not include notarized statement if that matters. He did a response motion.
    He called the courthouse expecting another hearing date but that is not what is happening. The information he received is that the judge is set to review or issue and order one day next week.
    How does he get his day in court? Has he missed doing something?

    Apparently the judge is ruling based upon their respective submissions.

    I don't see a statute or court rule that expressly requires a hearing, but I would find it a bit odd that no hearing were being held if a party has formally requested a hearing. I suggest that your son consult a local lawyer and have the lawyer review the documents filed with the court (his and hers), to see what additional steps he should consider.

    Just learned today that a hearing has been scheduled for July.
