    Exclamation Audio Recording of Conversation

    My question involves employment and labor law for the state of: Texas

    Please tell me if this belongs in another thread.

    Is it illegal to record a conversation between you and your co-worker while at work? If you know you will have a conversation with that person ahead of time, but dont know what they will say and you decide to record it..is that illegal? Is that something that can get you fired? What is the best way to handle something like this?

    Any and all advice is welcomed.

    Is it illegal? No. The law in Texas permits the taping of a conversation as long as on party to the conversation is aware of it. So since you are aware of it, it's not illegal, you're not committing a crime and the state will not throw you in jail.

    However, the fact that it is legal does not mean that your employer has to allow it. If you tape a co-worker (or supervisor, or manager, or HR representative, etc.) without their knowledge and without the permission of the employer, it will ALSO not be illegal if the company fires your ass.

    Ok, so what im understanding is....that recording a conversation between i and another person is ok. So long as 1 of the 2 people were aware { which i would, because i recorded it}....

    But also, although it is legal, it is also legal for the company to fire me for doing something legal? I assume its up to companys' policies...

    As you were just told, yes, you can be fired for secretly reporting people at work even if it's not a criminal offense.

    Yes, it is legal for the company to fire you for doing something legal. Where did you get the idea that you had to break the law before you could be fired?
