    Default Can I Have Battery Charges Filed Across State Lines

    My question involves criminal law for the state of: New Jersey

    Ok, I came to New Mexico with a guy who I was friends with at the time. We got into an argument and he attacked me. I had no alternative but to defend myself and he got 3 bruised ribs and a dislocated sternum. He got kicked off the project we were working on and had to return to New Jersey. Out of spite, he has sent me nasty emails and the last one said he filed a battery charge against me.

    So, my main question is, can he file battery charges against me in New Jersey for something that happened in New Mexico?

    Any help would be greatly appreciated, thanks in advance.

    No, because you were outside of New Jersey's jurisdiction when the offense occurred.

    Well, he could have asked his local police (in NJ) to take a courtesy report based upon the incident that occurred in NM. But if he did that, the charges would actually be 'filed' in NM. (once the report was forwarded etc...)

    Thank you so much guys. This has been such a huge amount of stress to me. The major thing is this, I am on a very light probation for a DUI, and this would violate it. On top of that, this project I am working on in NM is coming to an end and I am about to move back to NJ in a few weeks.
