    Default Company Knowingly Filed False Collection Against Me

    My identity was stolen in 1999 and has been used ever since for medical care. I live in Texas but the uses of my identity have been in Las Vegas Nevada since 2004. I have filed reports with the Federal Trade Commission, US Post Master, and put ID Theft fraud alerts on the three national credit-reporting agencies. The only police reports I can get are for "information only" at my local police department. No criminal charges have ever been filed against the suspect, legally I'm not the victim the Hospitals are because they are losing the money and they refuse to deal with it. Each incident takes me several months to clear and if it goes to collections it may take a year or more to clear.

    There were 17 accounts opened in 2008 many with the same hospitals multiple times. In the past I would not know about an incident until it showed up in my Credit Report months later. Even though the suspect uses a false local address when entering a hospital, the hospital has my Texas address on file and I get the bills in just a few days after he has been released.

    I live in Texas; the crimes are committed in Nevada, and the billing offices are all over the country. Many times I send all the needed paper work and the billing offices will tell me they know it's not me but still turn it over to collections causing false information to be put on my credit reports that is very difficult to get removed.

    I have shared my story with Friends that are Lawyers, Policemen, Ex FBI and Ex CIA but no one has any suggestions.

    Can I bring a lawsuit against the hospitals so they would have an interest stopping this? Can I sue the billing offices that knowingly file false collections against me?

    If the hospitals could reasonably stop it, they would. They want to get paid. Odds are this person has a nice little package of ID and documents that they use to pretend to be you, enough to get treatment (particularly in an ER setting) before anybody figures out there's a problem. I'm assuming they're going to different hospitals, not going back to one where you've already documented that they're wrongfully using your ID.

    I'm trying to think of what you might do. The fact that this is a health care matter makes it more difficult, as does it's being in another state, as does the victim technically being the hospital.

    The person continues to use the same hospitals where this has all been documented. By Federal Law the hospitals have to treat him and can't even ask his name until he is stabilized. My biggest beef is with the billing departments, they require that I provide a police report for each occurrence along with other supporting documentation. The police report is information only and I have spent 100's if not thousands of hours filling out paperwork that dose absolutely nothing to stop this. Example: I received a Physician's bill for emergency room visits for the end of Nov 2008 and mid Dec 2008. I filed a local police report on Jan 22, 2009. I faxed the 12 page document on Jan 28,2009. I received another ER Physician's bill same hospital the 1st of March showing an adjustment for 1/22/09 balance $0.00 but a $276.80 balance for 1/25/09. Since the last police report I had filed was on1/22/09 (by the way it was for Nov & Dec 08) they used it to clear the charges for 1/22/09 but required me to get another report for 1/25/09. Due to my own personal issues I was not able to send them the new report by the end of March and they have sent it to collections. Now that it is in collections it will most likely take me a year to get it off my credit report and lots more letters, phone calls and faxes. Because of my employment I have to keep clean credit or I would just say the heck with it. One more note this hospital (ER) had six documented occurrences in 2008 not counting other hospitals with multiple visits also.
