    Default Forcing Employees to Stand

    Hello. My question is about the state of Illinois.

    I am wondering if there are any limits to the amount of time an employer can legally have an employee stand (as in: up straight, as opposed to sitting) while on the job. This may be such a simple thing that there is no law or statute. But if there is, I would like to take a look at it. I also need to know if any such legal limit is affected by things such as frequency of breaks, the availability of something to lean on, predictable lulls in business, etc.

    For example, if an employee is working upright at a cash register, must the employer allow them to sit if there are no customers?

    As a follow-up, is any of this affected by disabilities, such as if an employee has back problems, etc?

    There are no laws that address this question. It is entirely up to the employer whether to allow employees to sit when there are no customers at the store, to use your example.

    If an employee has a disability that makes standing difficult, they are free to request an accomodation under the ADA. The employer will have the right to medical confirmation that the ADA applies and the employee is not necessarily entitled to the accomodation they want, only one that works.

    Thanks for your response! I have another follow-up...

    One of my employees believes that if asked to stand, there is a federal law requiring that we provide those squishy mats you find behind counters and cash registers. Any truth to this?

    Thanks so much for all the help! I don't know why these mats didn't occur to me. I'm gonna see about getting my higher ups to approve some of them.

    tell them it might help prevent an on the job injury BUT be sure that does not sound like a threat. The really can help prevent injuries and are truly in the best financial interest of an employer.
