    Default N400 Prior Convictions

    The N400 application clearly states that I should list any arrests even if they were expunged or if anyone, including a judge, said that I don't have a record.

    I have a juvenile record from about 25 years ago for shoplifting ($10). The sentence was postponed. My record was expunged (so I was told) and I was told by the judge that I can legally and truthfully claim that I have never been arrested. The record is from my country of origin.

    Is this something I should pay the money to a lawyer to discuss? I'm inclined not to list it, but I don't want to be perceived as having lied.

    When the USCIS asks you to disclose any and all incidents with law enforcement, even if they were expunged, it means exactly that.

    If the only thing on your record is an expunged juvenile incident from 25 years ago, it's not something to worry about. But you still have to provide a full, honest answer to the question.
