    Default Father Murdered Mom

    My question involves guardianship in the State of: Indiana

    I am looking for any information involving a similar case, even if it is in a different state. My half brother (Mark) murdered his wife (Mindy) in front of their 2 children, one an infant, the other 4years old. Mindy asked us to take the kids if anything ever happened to her. Mark asked us to get the kids 30 seconds after he shot her with a shotgun stating he didn't want anyone else to get the kids. I now have custody and guardianship of the kids. My estranged mother, and mother to murderer, is seeking grandparent's rights. I believe she is mentally unfit and abusive as I was abused. I am refusing her the ability to see the kids without supervision. She has protested and petitioned the courts for grandparents' rights. I do have an attorney but I am looking for anything to help ease our minds. My goal is to make sure she has no rights whatsoever, that Mark's parental rights are terminated, and have the ability to change the childrens' names and move out of state in the future without going through adoption of the children.

    Does anyone know of a similar case or have references to suggest I should read or present to my attorney or judge. The attorney and judge have never dealt with this before.

    Well, right now, that's the case. Grandparents have no inherent rights to access to grandchildren. She can petition the courts, but if she can't prove a well established, good relationship with the children, the breaking of which would be detrimental to them, the courts usually say No.

    If he's incarcerated for the murder of his wife, getting his rights terminated ought to be a swift and nearly painless process. Your attorney can file the paperwork for you.

    This is where it gets tricky. Without adopting the children, your right to do that may be limited. You'll need to sit down with your attorney to sort through options here, once Mark's rights are terminated.
