    Default Should I Appeal

    My question involves unemployment benefits for the state of: Michigan
    I have been having problems with my 4 year old son starting in jan 09 with his daycare. They would no longer accept my son in daycare because of his ADD so i found another daycare to take him too. Every day they would call me to pick him up because he wasn't listening. No doctor would prescribe him anything until he is in school. My supervisor and manager were aware of the issue for months. Finally the new daycare also removed him from being able to attend there. My work told me I couldn't apply for FMLA because its only for if a family member is sick and there is no part time positions avail when i tried to go part time till I had daycare situation taken care of. I resigned from my position instead of being fired ( Had alrdy used all pto time and was on 4th unexcused which equals termination) I applied for unemployment on 3/16/09, I received a questionnaire about a week later asking me why I left and if I was avail for work at that time which I am because I found a daycare that would take him with his ADD problem starting 3/30/09. I also sent in copies of the letters the daycare's gave me when he was kicked out of them. I then received a Notice of determination on 4/8/09 stating:

    You quit your job with (company name) on 3/16/09 due to problems with child care. Your leaving was voluntary and not the fault of the employer.

    It is found that you quit your job without good cause attributable to the employer. You are disqualified for benefits under mes act, sec. 29(1)(A)

    You are Disqualified for week ending 3/21/09 Until completion of a $4,344.00 Earnings rework requirement with has not been satisfied.

    In addition: You have stated you are not available for work due to lack of childcare from 3/16/09 through 3/29/09, You have childcare beginning on 3/30/09. You do not meet the availability Requirements of the mes act. You are ineligible for benefits from 3/15/09 through 4/4/09

    You are ineligible for benefits under the mes act, sec. 28(1)(c) for the period shown. It is found that you were not available for suitable full-time work.

    You are ineligible for benefits from and thru 3/15/09 - 4/04/09


    So the way i read the determination was that I couldn't claim until the weeks after 4/4/09 because I didn't have childcare until 3/30/09 which i do not argue so I called to find out for sure. I was told to receive any benefits I would need to complete a $4,344.00 Earnings rework requirement. Or another words find a job make $4.344 then reapply?? I wouldn't need unemployment if I was working. I read before i even applied for unemployment childcare is a reasonable reason to leave a job if documented. I Can't Afford the daycare to find a job without unemployment. I am a single father with full custody of my son. So my question is do I have a good appeal reason and is there any suggestions I could get. I have even gone as far as going to FIA for daycare assistance so I can find a job but can't get that because I'm not working.. Any help or comments would be appreciated.

    You read this where?

    It costs you nothing to appeal, and the worst that will happen is that they'll again deny you benefits.

    I read it on the ui website when i applied. It asked if fired, laid off or quit, Under option quit it says the only satisfactory reasons for quiting a job and still being able to apply for Unemployment is.. and childcare was one of the reasons.
